Your Rights Under the FDCPA
The Fair Debt Collection Practices Act provides significant protections for consumers dealing with debt collectors like AWA Collections. This federal law prohibits abusive, deceptive, and unfair collection practices. Debt collectors cannot use threatening language, call at unreasonable hours, or contact consumers at work if prohibited by their employer.
Consumers have the right to request debt validation within 30 days of initial contact. The collector must provide proof that the debt is valid, including details about the original creditor and amount owed. If AWA Collections cannot verify the debt properly, they may be required to cease collection efforts.
The FDCPA also grants consumers the right to dispute debts and request that collectors stop contacting them. Written communication requesting cessation of contact must be honored, though collectors can still pursue legal remedies. Violations of these rights can result in penalties against the collection agency.
